§1 Validity towards entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order via the online shop:

(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity (§ 13 BGB).

(3) An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity which, when concluding a legal transaction, acts in the exercise of its commercial or self-employed professional activity (§ 14 BGB).

§2 Formation of a contract, storage of the contract text

(1) The following regulations regarding the conclusion of a contract apply to orders via our online shop http://www.ueberzieher.me .

(3) The presentation of goods in our online shop does not constitute a legally binding contract offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer submits a binding contract offer by successfully completing the ordering procedure provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods
2) Confirmation by clicking the "Add to cart" buttons
3) Checking the details in the shopping cart
4) Activation of the "Checkout" button
5) Entering shipping information (email address, name, and address).
6) Confirmation of the flat-rate shipping costs.
7) Selecting the payment method (PayPal, immediate bank transfer).
8) "Checking the box" to accept the General Terms and Conditions (GTC), the Privacy Policy, and the Right of Withdrawal/Right of Return.
9) Binding submission of the order by clicking the "Order with obligation to pay" button

Before the binding submission of the order, the consumer can return to the website where the customer's details are recorded to correct input errors by pressing the "Back" button contained in their internet browser after checking their details, or by closing the internet browser to cancel the ordering process. We confirm receipt of the order immediately by means of an automatically generated email ("Order Confirmation"). With this, we accept your offer.

(5) Storage of the contract text for orders via our online shop: We will send you the order details and our GTC by email. You can also view the GTC at any time at https://www.ueberzieher.me/agb. For security reasons, your order details are no longer accessible via the internet.

§3 Prices, shipping costs, payment, due date

1. All stated prices include statutory VAT.

(2) In addition to the stated prices, shipping costs may apply. These are clearly communicated to the customer during the ordering process.

(3) The following payment methods are offered:

(4) The payment instrument is charged immediately after the order is completed.

§4 Delivery and shipping

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Delivery will take place within 14 working days at the latest. We ask for your understanding as the items only go to print after the order is placed and are not in our stock. In the case of payment by advance payment, the delivery period begins on the day following the payment order to the bank commissioned with the transfer, and for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item only passes to the buyer upon handover of the item, even in the case of mail-order purchase.

(3) If a delivery cannot be made for reasons attributable to the customer and the goods are returned to the seller, a flat-rate return fee will be charged.

Reasons attributable to the customer include in particular:

• Unreachability of the recipient
• Refusal of acceptance
• Exceeding the storage or collection period
• Provision of an incorrect or incomplete delivery address

The flat-rate return fee is:

• €5.90 for domestic shipments (Germany)
• €12.90 for international shipments

The return fee will be deducted from the refund amount or billed to the customer separately.

(4) For personalized or custom-made products, the delivery time may be extended.

(5) If a product is not available, the customer will be informed immediately.

§5 Retention of title

We retain ownership of the goods until the full purchase price has been paid.

Consequences of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including the costs of the cheapest standard delivery.

The repayment will be made immediately and within fourteen days at the latest from the date we receive your notice of withdrawal.

For this repayment, we will use the same payment method you used for the original transaction.

We may withhold the refund until we have received the goods back or until you have provided proof that you have sent the goods back.

You must return the goods immediately and within fourteen days at the latest from the date you notify us of the withdrawal.

The direct costs of the return shipment shall be borne by the customer.

 

Returns

 

If you are not satisfied with your ordered items or they do not fit, do not worry.

You bear the return costs unless we have made a mistake or an item is defective.

We recommend that you send your return using a service that offers tracking, proof of delivery, or transport insurance.

We cannot refund a return if we have not received it.
After receiving your return, we will refund the amount originally paid for the returned items to the payment method you originally used for the purchase.

We cannot cover a refund of the originally paid shipping costs.
Even if you only return part of your original order, we will not refund any shipping costs.

 

§7 Exclusion of the right of withdrawal for personalized products

(1) The right of withdrawal does not apply to contracts for the delivery of goods,

-which are not prefabricated and

-for the production of which an individual selection or determination by the consumer is decisive or

-which are clearly tailored to the personal needs of the consumer.

(2) This applies in particular to personalized merchandise products such as items with names, individual motifs, dates, or other customer-specific adjustments.

(3) An exclusion does not apply if the goods are defective or do not correspond to the order.

§8 Warranty

Do not wash fresh print until after 24 hours!

Always wash inside out

Maximum temperature of 30 degrees with mild detergent on a gentle cycle

Bleaching not allowed

Dry cleaning not allowed

Tumble drying not allowed

Do not iron over the print; iron from the inside

§9 Vouchers and validity

(1) Vouchers are valid from the date of purchase for the statutory limitation period of three years, unless a different validity period is specified on the voucher.

(2) The period begins at the end of the year in which the voucher was purchased.

(3) Vouchers can only be redeemed in the seller's online shop.

(4) Cash payment of the voucher value is excluded.

(5) The seller accepts no liability for loss, theft, or illegibility of the voucher.(6) Vouchers are transferable unless otherwise agreed.

 

§10 Contract language

German is the only language available for the conclusion of the contract.

§11 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR):

The seller is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
